Repeat Infringer Policy
Introduction
220 by Sly is committed to respecting the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and in our efforts to comply with its provisions, we have adopted a policy that provides for the termination, in appropriate circumstances, of users of our service who are repeat infringers. This Repeat Infringer Policy outlines our approach to handling repeat offenses and our commitment to protecting copyright and other intellectual property rights.
Definition of a Repeat Infringer
A repeat infringer is a user who has made content available through our service and for whom 220 by Sly has received more than two takedown notices compliant with the provisions of the DMCA, with respect to copyright infringement. The determination of whether a user is a repeat infringer is at the sole discretion of 220 by Sly, considering the facts and circumstances of each case.
Notification Process
220 by Sly follows a detailed procedure for handling infringement notices and counter-notices as outlined in our DMCA compliance policy. Upon receipt of a valid DMCA takedown notice, we will promptly remove or disable access to the allegedly infringing content. The user responsible for posting the content will be notified of the takedown and given an opportunity to submit a counter-notice.
Consequences for Repeat Infringers
Upon the determination that a user is a repeat infringer, 220 by Sly will take appropriate action, which may include, but is not limited to, the following:
- Suspension of the user’s account.
- Termination of the user’s account and deletion of all content posted by the user.
- Prohibition of the user from creating any new accounts on 220 by Sly in the future.
220 by Sly reserves the right to decide whether to suspend or terminate an account, or take any other action, against a repeat infringer based on the severity of the infringement and the user’s history on the platform.
Restoration of Removed Content
If a user submits a valid counter-notice in response to a takedown notice, and the copyright owner does not notify us that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the content on 220 by Sly, we may restore the removed content in accordance with the DMCA.
Modification of the Policy
220 by Sly reserves the right to modify this Repeat Infringer Policy at any time. Any changes will be effective immediately upon posting on our website or service. Users are encouraged to periodically review this policy to stay informed of our efforts to combat repeat infringement.
